The Manual of Disciplinary Proceedings is a document that deals with the procedures to be followed in cases of disciplinary proceedings and provides guidelines on how to proceed. The Manual deals with what kind of misconduct is considered grounds for proceeding and the punishments/remedies and the like. A copy of it can be downloaded from this site free of cost. This document covers two main aspects: -What constitutes as misconduct or an act that might warrant disciplinary proceedings under this Manual -Steps to be taken once such a case has been confirmed as well as penalties, remedies etc. Below are the different sections that will be covered in the rest of this document. The Manual of Disciplinary Proceedings is an initiative undertaken by Government to streamline this process through a common set of procedures and guidelines. The other main objective of this Manual is to ensure that the disciplinary proceedings are conducted in an expeditious manner with transparency, fairness and efficiency. Besides, since different institutions come under different Acts/rules, each one having its own set of procedures for disciplinary proceedings (in fact, no 2 institutions will have the same procedures), it was felt necessary to create a common set of procedures for smooth functioning across various institutions. Also, the Manual is also based on the recommendations of the Committee to Review Grievance Redressal Mechanisms in Higher Educational Institutions formed by Ministry of Human Resource Development, Government of India. The disciplinary authority decides what action should be taken against a staff member who has misconducted himself/herself. The process for deciding this begins with the filing of an application by an employee or by any other concerned party. Such applications are filed with the Registrar. However, if they are against Vice-Chancellors/Deans/other Heads of institutions they are filed directly with Shri. Jaspal S Sandhu, Secretary (Higher Education), University Grants Commission. The institution or the concerned party has to file an application giving full and detailed particulars of allegations and other information as required by the Manual. The application may enclose any supporting documents, but it must contain the following: The authority may not reject an application solely on the ground that it fails to provide all or any of these particulars. The Registrar/Secretary (Higher Education) will decide whether to deal with the application himself/herself or delegate the case to another authority. If the authority to be delegated is one other than the Registrar, then reasons for this must be stated in writing. If the case is not to be handled by the Registrar/Secretary (Higher Education) himself/herself, or if he/she so desires and if he/she so states in his application to delegate the case, then a copy of it has to be sent to the Secretary (Higher Education). Upon receipt of an application filed by either party to a disciplinary proceeding, as mentioned above, or as directed by another authority (possibly as also as directed by the Minister) as mentioned below, The Registrar will decide whether disciplinary proceedings should be initiated against those staff members who have been named in such applications. cfa1e77820
